Online Store Regulations
§ 1. Preliminary Provisions
1.1. The online store, hereinafter referred to as the “Store”, sells digital print illustrations via the website available at https://igorpiw.shop, hereinafter referred to as the “Website”.
1.2. The owner of the Store and the Data Administrator is WTEM Igor Piwowarczyk, located at ul. Na wzgórze 19, 32-540 Trzebinia, Poland, with a VAT ID PL6282269287 and REGON number 366956700.
1.3. These regulations, hereinafter referred to as the “Regulations”, comply with Polish law, including the Consumer Rights Act and the Omnibus EU directive, and define the rules for using the Store and concluding sales contracts for products offered in the Store.
§ 2. Definitions
“Seller” – WTEM Igor Piwowarczyk, owner of the Store.
“Customer” – a natural person, a legal entity, or an organizational unit without legal personality, making a purchase in the Store.
“Product” – a fine art giclee print offered for sale in the Store.
“Sales Agreement” – a sales contract for the Product concluded between the Customer and the Seller via the Website.
§ 3. Placing and Fulfilling an Order
3.1. Orders for Products offered in the Store can be placed via the Website 24 hours a day, 7 days a week.
3.2. To place an order, the Customer should select a Product, specify the quantity, add the Product to the cart, and then proceed to the ordering process, providing required personal and address data, and choosing a payment method.
3.3. By placing an order, the Customer makes an offer to the Seller to buy the selected Product under the conditions specified in the Product description.
3.4. After placing an order, the Customer will receive an automatic confirmation of its acceptance for processing along with a summary of the order.
3.5. The sales agreement is considered concluded once the Seller sends the Customer an email confirmation of the order acceptance for processing.
§ 4. Prices and Payments
4.1. Product prices are given in Euro (EUR) and include all taxes but do not include delivery costs, which are additionally payable.
4.2. The Customer can make payment for the order via the online payment systems Przelewy24 and Stripe, including credit card payments.
4.3. The Seller informs the Customer of the total order cost, including delivery charges, before finalizing the order.
§ 5. Delivery
5.1. Delivery of Products is possible within Poland and to other countries, according to delivery options indicated in the order process.
5.2. The order processing time is up to 3 business days from the date of payment being credited to the Seller’s account, unless the Product description specifies otherwise.
5.3. Delivery costs depend on the chosen delivery method as well as the weight and dimensions of the package.
§ 6. Right of Withdrawal from the Agreement
6.1. The Customer, being a consumer, has the right to withdraw from the purchase agreement without giving any reason within 14 days from the date of receiving the Product.
6.2. The withdrawal from the agreement is made by submitting to the Seller a relevant declaration, a template of which is available on the Website.
6.3. In the event of withdrawal from the agreement, the agreement is considered as not concluded, and the Customer is obligated to return the Product to the Seller immediately, no later than within 14 days from the day on which they withdrew from the agreement.
§ 7. Privacy Policy and Personal Data Protection
7.1. The Administrator of personal data collected via the Website is the Seller.
7.2. Personal data is processed for the purposes related to the execution of the sales agreement, handling complaints and returns, and, if the Customer consents, for marketing purposes.
7.3. The Customer has the right to access their data, rectify it, delete or limit processing, as well as the right to object to processing, and the right to data portability.
7.4. Detailed information on the rules of personal data processing and the rights of Customers can be found in the Privacy Policy available on the Website.
§ 8. Final Provisions
8.1. Any disputes arising from the execution of sales agreements between the Seller and the Customer will be settled by the courts appropriate for the Seller’s location.
8.2. The Seller reserves the right to make changes to the Regulations. Changes to the Regulations come into effect on the date specified by the Seller, no shorter than 7 days from the date of their announcement.
8.3. Orders placed before the entry into force of the new Regulations are executed based on the Regulations that were in force on the day the Customer placed the order.
